Terms of Service governing your use of PhasmaVPN.

1. About these Terms

These Terms of Service ("Terms") are a binding agreement between you ("User" or "you") and PhasmaVPN ("we", "us", or "the Company"). These Terms govern your use of all PhasmaVPN products: the desktop application for Windows and macOS, the mobile application for iOS and Android, the browser extensions for Chrome and Firefox, and the website at phasmavpn.com (collectively, the "Services"). By using the Services, you agree to be bound by these Terms, our Privacy Policy, and our No-Log Policy, which are incorporated by reference.

2. What is PhasmaVPN

PhasmaVPN is a virtual private network service. It encrypts your internet connection using WireGuard and routes it through our servers. There is no account to create, no email to provide, no payment to make. The app generates a key pair on your device when you first run it. The private key stays on your device. The public key is used to establish the encrypted tunnel.

3. Accepting these Terms

The first time you open any PhasmaVPN app, a screen shows these Terms. You must click to accept before the app will work. If you do not accept, the app does not start. We may amend these Terms at any time, at our sole discretion, without prior notice. We will make a reasonable effort to notify you of material changes. Continued use of the Services after any amendment constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the Services and uninstall all Products.

4. Who can use PhasmaVPN

You must be at least 13 years old to use PhasmaVPN. If you are under 18, a parent or legal guardian must agree to these Terms on your behalf. By using PhasmaVPN, you confirm you meet these requirements.

5. What you can and cannot do

PhasmaVPN is for lawful personal use. You are responsible for everything you do through the connection. You may not use PhasmaVPN to break the law, attack other systems, spread malware, send spam, share illegal content, or harass people. You may not try to reverse engineer the app, bypass security features, or resell access to the service.

6. Updates

The desktop and mobile apps check for updates automatically. Updates are signed with a cryptographic key so only official builds can be installed. Browser extensions update through the Chrome Web Store or Firefox Add-ons. We recommend keeping the app up to date for security.

7. Your data

We have a No-Log Policy that explains exactly what data we do and do not collect. In short, we do not log your browsing activity, DNS queries, or traffic content. We keep only minimal technical data needed to run the connection. Crash reports are sent to Sentry to help fix bugs and are deleted at the start of each month. 8. Service availability

We run our own servers and do our best to keep them online. The service may go down for maintenance, technical issues, or events we cannot control. We do not guarantee the service will always be available or work perfectly.

9. Liability

To the extent the law allows, we are not responsible for any indirect or consequential damages from using PhasmaVPN. This includes lost profits, lost data, or other intangible losses.

11. Termination

If your use of PhasmaVPN causes a third party to make a claim against us, you agree to cover our costs. This includes legal fees and any damages we have to pay because of your actions.

12. Intellectual property

You can stop using PhasmaVPN at any time by uninstalling the apps. We can suspend or terminate your access if you violate these Terms. When these Terms end, the sections about intellectual property, warranties, liability, and indemnification continue to apply.

13. Governing law

PhasmaVPN, the name, logo, and all the software are owned by PhasmaVPN. These Terms give you permission to use the apps, not to own them. You cannot copy, modify, distribute, or reverse engineer the software.

14. Third-party services

When you use PhasmaVPN, you may access websites, services, or content operated by third parties. We have no control over and assume no responsibility for the content, privacy practices, or availability of any third-party sites or services. Your use of third-party services is at your own risk and subject to their own terms and conditions.

15. Traffic routing

PhasmaVPN operates a distributed network infrastructure. When you use our Services, your requests are processed through this infrastructure. You acknowledge that we may route, process, or relay traffic as necessary to provide the Services.

16. Force majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to events beyond our reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, government actions, power outages, network failures, distributed denial-of-service attacks, or disruptions to internet infrastructure.

17. Assignment

We may transfer or assign our rights and obligations under these Terms to any third party, including in connection with a merger, acquisition, sale of assets, or similar corporate transaction, without your prior consent. You may not assign or transfer your rights or obligations under these Terms.

18. Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision. Any waiver of any right or provision must be in writing and signed by the waiving party.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced by a valid provision that most closely reflects the original intent.

20. Entire agreement

These Terms, together with our Privacy Policy and No-Log Policy, constitute the entire agreement between you and PhasmaVPN regarding the use of the Services. They supersede any prior agreements, understandings, or communications, whether oral or written.

21. Dispute resolution

These Terms are governed by the laws of France. If you live in the European Union, the mandatory consumer protection laws of your country also apply. For EU consumers, you may use the European Commission Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
